Net Abuse Policy

Goals:
Electronic Commerce Engineering Corporation
's goals are to protect network resources, preserve the privacy and security of our customers and dealers, and to maximize the utility of Electronic Commerce Engineering Corporation and the Internet, while recognizing our position in the Internet community as a whole.

Interpretation:
The provisions of this Policy are intended as guidelines and are not meant to be exhaustive. Generally, conduct that violates law, regulation, or the accepted norms of the Internet community, whether or not expressly mentioned in this Policy, is prohibited. Electronic Commerce Engineering Corporation reserves the right at all times to prohibit activities that damage its commercial reputation and goodwill.

Security:
Any "denial of service" attacks, any attempt to breach authentication or security measures, or any unauthorized attempt to gain access to any other account, host or network is prohibited, and will result in immediate termination of service or affiliation with Electronic Commerce Engineering Corporation, which may be without notice.

Email And Usenet News:
Using any Electronic Commerce Engineering Corporation account or server to send duplicative, unsolicited email messages (commercial or otherwise), or to collect the responses from unsolicited email, is prohibited. Similarly, using any Electronic Commerce Engineering Corporation account or server to post advertisements or messages that violate the charter of any newsgroup or mailing list is prohibited.

Electronic Commerce Engineering Corporationreserves the right to make the determination whether a given message violates the newsgroup or mailing list charter. In most cases, Electronic Commerce Engineering Corporation will defer to the judgment of the newsgroup or mailing list moderator or administrator.

Commercial messages that are appropriate under the charter of a newsgroup or mailing list, or that are expressly solicited by the recipients, are permitted.

Conduct in connection with email or Usenet news that is an obvious nuisance (such as sending of unsolicited commercial email or "mail bombing") or that would be unlawful in other contexts (for example, threats, harassment, defamation, obscenity, or software piracy) is prohibited.

Falsifying addressing information or otherwise modifying headers to conceal the sender's or recipient's identity, for the purpose of circumventing this Policy, is prohibited. This provision is not intended to disallow the use of aliases or anonymous re-mailers for any legitimate purpose.

Copyright, Privacy, and Intellectual Property Using an Electronic Commerce Engineering Corporation connection to commit, aid or abet any violation of copyright or intellectual property law is prohibited. This prohibition includes publishing a private email message to third parties, by any means, without the express prior consent of the author.

Using Electronic Commerce Engineering Corporation's facilities, which include but are not limited to dealer provided web sites, to engage in activities that violate the Terms of Service of Electronic Commerce Engineering Corporation or any other network access provider is prohibited. For example, referring to a web site hosted by Electronic Commerce Engineering Corporation through UCE (unsolicited commercial email) is strictly prohibited.

Unsolicited Email (Spam) & Abuse of Mail Server
Sending unsolicited email is prohibited. Sending a message, especially an advertisement, to more than five or six recipients, is by itself spamming unless the individuals have specifically requested to be added to a mailing list on that topic. Maintaining an open SMTP relay is prohibited. When a complaint is received, Electronic Commerce Engineering Corporation, at its own discretion may determine if a violation of this policy exists. Clients that have selected Standard Web Hosting may not send more than 2000 emails per day. Clients that require sending more than 2000 emails per day may upgrade to a Dedicated Server. Failure to comply with this policy may result in account suspension, termination without refund and/or up to a $500 fine per incident.  Electronic Commerce Engineering Corporation will be the sole arbiter of what is considered a violation of this policy.

REFERRING TO ANY Electronic Commerce Engineering Corporation OWNED OR OPERATED WEB SITE WITH UCE (UNSOLICITED COMMERCIAL EMAIL) IS STRICTLY PROHIBITED.

Consequences Of Violation:
Violation of this Policy by an Electronic Commerce Engineering Corporation customer or dealer may result in temporary suspension or permanent termination of service, at Electronic Commerce Engineering Corporation's sole discretion. Electronic Commerce Engineering Corporation also reserves the right to hold customer or dealer monetarily liable for any damage to equipment, any and all liabilities, losses, costs and claims, including attorney's fees asserted against Electronic Commerce Engineering Corporation, its agents, its customers, officers and employees, any loss of data resulting from delays, and any and all service interruptions whether they be caused by Electronic Commerce Engineering Corporation and its employees or other third parties that may arise or result from any violation of this policy.

Modification:
Electronic Commerce Engineering Corporation reserves the right to add, delete, or modify any provision of this Policy at any time without notice. Please report any violations of this Policy to our office.
